Probate Real Estate Agent on the Palos Verdes Peninsula
A Palos Verdes home can be marketed during probate and sold once the court has issued your letters. Peninsula estates carry two complications the rest of the South Bay does not: the disclosure work is heavier, because of geology, views, and decades of owner alterations, and the four cities on the hill each regulate what you may do to the property before you sell it.
If you are the executor, administrator, or trustee for an estate that includes a house on the Palos Verdes Peninsula, you have inherited a more complicated property question than the same role would carry a few miles downhill. Peninsula homes sit on large lots, they have usually been held for decades, and the four cities on the hill each have their own rules about what you may change. We handle probate and trust sales here from our office in Manhattan Beach.
Four cities, four sets of rules
Palos Verdes Estates, Rancho Palos Verdes, Rolling Hills Estates, and Rolling Hills are separate cities, and an executor cannot assume what applies in one applies next door.
In Palos Verdes Estates, exterior alterations go before an art jury, so the cosmetic freshening an executor might order without thinking can require a review the estate does not have time for. Rolling Hills is gated and private, which shapes how a property can be shown and how long marketing takes. Rolling Hills Estates has horse-keeping properties where the corral, trail access, and zoning are part of the value, and a listing that ignores them undersells the house. Rancho Palos Verdes is the largest of the four and the most varied, which means citywide price figures tell you very little about any particular street.
Before you approve any work on the property, it is worth knowing which city you are in and what that city will let you do.
The disclosure work is the real job here
Peninsula estates generate more disclosure than most executors expect, and getting it wrong is how a sale falls apart late.
Land movement is the first item. Parts of Rancho Palos Verdes, particularly around Portuguese Bend, sit in a recognized landslide area, and geologic conditions affect insurability, lending, and what a buyer will pay. Even well outside those zones, buyers and their lenders ask about slope, drainage, and soils. If the family holds old geology or engineering reports, find them early, because they are difficult to reconstruct after the fact.
Views are the second. A great deal of a Peninsula property's value is the view, and views are affected by vegetation that grew for thirty years while the owner aged in place. Some of that is the estate's to trim and some of it is a neighboring property's, and Rancho Palos Verdes has a view restoration process that is slower than any escrow. Knowing what the view will be, rather than what it was, matters to the price.
Alterations are the third. Long tenure and large lots produce decades of additions, pools, walls, decks, and guest quarters, not all of which went through permits. Trevor Plunkett spent two decades in construction, which helps in going through the property and the records before listing rather than discovering a problem during a buyer's inspection.
The court process, and the timing it forces
You may list and market the property once the court appoints you, but escrow cannot close until your letters testamentary or letters of administration have issued. The California probate timeline sets out the order.
Los Angeles County probate is heard downtown at the Stanley Mosk Courthouse, not on the Peninsula. Whether you hold Full Authority or Limited Authority decides whether the sale needs a confirmation hearing and can be overbid in the courtroom, and under Limited Authority a confirmed sale generally has to reach at least ninety percent of the probate referee's appraised value. On the Peninsula, where values differ sharply between two streets, that appraisal deserves attention before you respond to an offer. Our probate FAQs cover the authority question in more detail.
If the property is held in a trust
More Peninsula owners hold their homes in living trusts than elsewhere in the South Bay, and if this one is properly titled to a trust you may not be in probate at all. A successor trustee can generally sell without a court confirmation hearing, without a probate referee's appraisal, and without the ninety percent floor, which removes most of the timing pressure described above.
That does not remove your obligations. You still owe the beneficiaries a defensible process, which in practice means documenting how the property was priced, how it was marketed, and why you accepted the offer you accepted. Where beneficiaries disagree with each other, that documentation is what protects you. We work with trustees on exactly that footing, and a CPA's view of the basis and tax consequences is usually part of the conversation.
Who you would be working with
Michelle Plunkett is a licensed California real estate broker, a CPA, and a licensed attorney, and holds the Certified Probate Specialist designation. A Peninsula estate sale runs into property law, tax treatment, and market judgment at once, which matters most when the real estate is the difficult part of the case. We are a two-person team, so you deal with us directly.
If the estate's property is in Torrance, Manhattan Beach, Redondo Beach, or Hermosa Beach, those pages cover those markets. For anywhere else in Los Angeles County, see our Los Angeles County page.
Where to start
Tell us the address and where the case stands. We will tell you what the disclosure work looks like, what the city will allow before a sale, and what the property is worth as it sits today. If you are still establishing what the role requires, read the duties of a personal representative and the mistakes we see most often.
